The petitioner has filed this Writ Petition under Article 226 of the Constitution of India against the order No.406/PUN/A.A//F.N.2/2022 dated 5-1-2023 and order No. 407/PUN/A.A//F.N.2/2022 dated 5-1- 2023 issued by respondent No.3 /Commandant, Mana Camp, Raipur, Rehabilitation Department, Raipur, CG, for eviction of the petitioner from the house/quarter No. N-5/1 at P.L. Home Mana Camp, Rehabilitation Quarters on the count that the petitioner stood retired from service on 31-12-2021. 2. The brief facts of the case are that the petitioner was working as Company Commander (Security OfÏcer) at Secretariat, Government of Chhattisgarh and stood retired on 31-12-2021. The petitioner was allotted a Quarter No. N-5/1 at P.L. Home Mana Camp, Rehabilitation Quarters. After his retirement, respondent authority has issued notice to vacate the house Even after more than four years have lapse, the petitioner has not vacated the quarter allotted by the respondent authority. 3. Learned counsel for the petitioner would submit that he has not disputed that the petitioner stood retired from service on 31-12- 2021 but he would submit that on the basis of compliant made by the complainant, the proceedings drawn by the authority have already been redressed by allowing the Government Quarter No. N- 5/1 at P.L. Home Mana Camp, Rehabilitation Quarters. Raipur, therefore, the basis of the complaint has lost its significance. 4. On the other hand, learned State counsel opposing the aforesaid submission would submit that it is not the private respondent who was aggrieved by continuing the possession of the house by the petitioner who is illegally in possession of the house even after 3 retirement and it is the Government which is suffering as the Government is required to accommodate the employee who is in Government service. Thus, he would pray for dismissal of the writ petition. 5. From bare perusal of the notice dated 5-1-2023, it is quite vivid that only show cause notice has been issued to the petitioner. Let the petitioner file reply to the show cause notice and thereafter the respondent authority will conduct the proceeding, in accordance with law. 6. With the aforesaid observation and direction, this writ petition is disposed of. 7. Pending interlocutory applications, if any, also stand disposed of.
