learned counsel for the petitioner. Also heard Mr. DP Borah, learned Standing Counsel, Health Department. 2. The petitioner before the Court is a candidate who had cleared the National Eligibility-cum-Entrance Test (Undergraduate) -2026 (NEET-UG 2026) from Kota, Rajasthan. Under the procedure prescribed, the State Government had issued the educational notice dated 11/08/2026 informing all concerned that the admissions into MBBS/ BDS courses in the Government Medical and Dental Colleges of Assam will be as per the Medical Colleges and Dental Colleges of Assam (Regulation of Admission into 1st year MBBS/ BDS courses) Rules, 2017 and all candidates whose names and roll numbers are present in the Assam State Provisional Merit List of NEET-UG 2026 will be eligible to participate in the counselling, if otherwise eligible. 3. The Learned Senior Counsel for the petitioner submits that the petitioner is a resident of South Salmara, Mankachar and he satisfies all other requisite qualifications. However, considering the poor communication facilities, including internet facility within the vicinity of the district of South Salmara, Mankachar, the petitioner was not able to have access to the educational notice dated 11/08/2026. As a consequence thereof, he was not able to apply and his name did not figure in the Provisional Assam State Merit List of NEET-UG-2026. He
Page No.# 3/4 filed the representation before the Director of Medical Education, Assam, requesting him to include his name in the provisional list so that he can participate in the counselling process reserved for the Assam Medical and Dental Colleges. Apprehending that his representation will not be redressed, the petitioner has approached this Court praying for urgent orders. 4. Mr. DP Bora, learned Standing Counsel for the Health Department appearing for the respondents, submits that once the notice is issued and other students have already applied and the petitioner having not applied, his name did not appear in the Provisional Merit List. The learned Standing Counsel for the Health Department has further placed before the Court the subsequent Educational Notice dated 12-08-2026, whereby the schedule for online registration has been published, which provides the online registration for counselling will commence on 13-08-2026 to 15-08-2026.
It is submitted that it is only the names of the candidates whose names appeares in the Provisional Merit List will be eligible for registration for the First (1st) round of online counselling for admission into First (1st) year MBBS/BDS courses of the Government Medical and Dental Colleges of Assam for the session 2026. 5. Considering the prayers made, this Court views it appropriate to permit the petitioner to file a detailed representation explaining his conditions with a
Page No.# 4/4 request before the Director of Medical Education (DME), Assam during the course of the day. The said representation, if filed, will be considered by the DME, Assam sympathetically and thereupon, pass appropriate orders addressing the grievances of the writ petitioner. Needless to say, any such order that may be passed, copies thereof shall be served on the writ petitioner. 6. The petitioner is permitted to file the proper application physically before the DME, Assam and any such order that may be passed by the concerned Authorities can be communicated to the writ petitioner through the e-mail address or contact number, which will be intimated by the petitioner to the DME Authorities. 7. With the above observation and without expressing any opinion on the merits of the case, the writ petition stands disposed of. JUDGE Comparing Assistant
