This bail application has been filed on behalf of Bechni Devi @ Wachni Devi who is in custody since 16.05.2025 in connection with Deori P.S. Case No. 36 of 2025 for the offence registered under Sections 103(1) and 3(5) of the BNS pending in the Court of learned, J.M. 1st Class, Giridih, is pressed into motion. It is submitted by learned counsel for the petitioner that petitioner is the sister-in-law (Gotni) of the deceased and general allegation of taunting the deceased for not having any child of her own was being made by the entire family. The husband of the deceased has been granted bail. It is further submitted that the facts, as alleged, will not constitute abetment to commit suicide. These were normal wear and tear of family life and in the absence of any overt act of abetment, offence under Section 103(1) of BNS will not be made out. Learned counsel for the State has opposed the prayer for bail and submitted that the petitioner is the main accused and there are direct and specific allegations of abetment to commit suicide. Death was caused due to poisoning which has been supported by the FSL report. Under the aforesaid facts and circumstances, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty- Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
