The complainant is filed in present complaint alleging willful disobedience of the order dated 11.01.2024, whereby the learned Single Judge of this Court in W.P.No.12355/2023 (KLR-RES) had disposed of the writ petition with a direction to the accused to consider the complainant's online application and to carry out the podi and durasth work in respect to the subject land. 2. The accused has filed an affidavit stating that they have forwarded a letter to the Assistant Commissioner along with a checklist for consideration of the appellant's representation for conduct of podi and durasth work. Pursuant thereto, the Office of - 3 - HC-KAR NC: 2026:KHC:8141-DB CCC No. 244 of 2025 the Tahsildar, Kapu Taluk had called upon the office of the Tahsildar, Udupi Taluk, seeking a report of the original record available in the said office. However, no such documents were found. It is further stated that Sy.No.188/5 is an imaginary one and therefore the podi and durasth work could not be done. 3. Without going into the merits of the endorsement made by the accused, it is apparent that proceedings for willful disobedience of the order dated 11.01.2024 are not required to be initiated against the accused. The complaint is accordingly closed. 4. We, however clarify that if the complainant is aggrieved by the endorsement on the grounds of which his request for podi and durasth has been rejected, the complainant is not precluded from availing of the remedies, if any, in accordance with law.
