1. List has been revised. Supplementary affidavit filed today is taken on record. 2. Heard Sri Rajiv Kumar Pandey, learned counsel for the applicant, Sri V.K.S. Parmar, learned A.G.A. for the State and perused the material placed on record. 3. Applicant seeks bail in Case Crime No.0616 of 2026, under Sections 191(2), 191(3), 190, 115(2), 352, 351(3), 126(2), 109(1) B.N.S., & Section 3/25 Arms Act, Police Station- Quarsi, District- Aligarh, during the pendency of trial. 4. Learned counsel for the applicant has argued that the allegations are per se false. The FIR was delayed by about 15 hours, and there is no explanation for the said delay. The injury sustained by the injured person is simple in nature. He has not sustained any gunshot injury. The criminal history assigned to the applicant stands explained, as in two cases assigned to him, he is neither named in the FIR nor has the final report (charge-sheet) been filed against him. He in jail since 27.07.2026 and undertakes to cooperate with the trial and not misuse the liberty of bail. 5. Per contra, learned A.G.A. has vehemently opposed the bail application on the ground that the criminal history of two cases assigned to the applicant has not been explained, as no orders have been appended, i.e., Case Crime Versus Counsel for Applicant(s) : Rajiv Kumar Pandey Counsel for Opposite Party(s) : G.A.
Abdulla .....Applicant(s) State of U.P. .....Opposite Party(s)
No.941 of 2019, under Sections 498A, 313 I.P.C., Police Station Quarsi, District Aligarh, and Case Crime No.959 of 2019, under Sections 498A, 323, 313 I.P.C. and Section 3/4 Muslim Marriage Act, Police Station Quarsi, District Aligarh. 6. After hearing learned counsel for the parties and taking into consideration the fact that the criminal history assigned to the applicant has not been properly explained, I do not find it a fit case for grant of bail to the applicant. The bail application is found devoid of merits and is, accordingly, rejected. 7. However, it is directed that the aforesaid case pending before the trial court be decided expeditiously, as early as possible, in accordance with law, if there is no legal impediment. 8.
It is clarified that the observations made herein are limited to the facts brought in by the parties pertaining to the disposal of bail application and the said observations shall have no bearing on the merits of the case during trial.
