Goswami, learned Addl. Public Prosecutor, Assam for the State respondent. 2. This bail application has been filed by the petitioner namely, Md. Alauddin Ali, under Section 483 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, for granting bail in connection with NDPS Case No. 11/2019 under Page No.# 2/2 Section 22 (C) of NDPS Act. 3. The petitioner was initially arrested in connection with the aforesaid case, on 26.06.2019 and subsequently he was released on bail by the learned Trial Court as stated in the instant petition subsequently upon failure of the petitioner to appear before the learned Trial Court, NBWA was issued against him, pursuant to which he was arrested on 20.03.2026 and since then he has been languishing in jail. 4. It is the submission on behalf of the petitioner that the petitioner had been appearing prior to the period of commencement of the Covid pandemic, but subsequently he did not appear, as he was under the impression that he would receive fresh notice from the Court. 5. It is further submitted that there was no intention on the part of the accused to avoid the trial. 6. Having regard to the above, as well as the period of detention of 138 days pursuant to execution of the NBWA, the prayer for bail is allowed. The petitioner shall be released on bail on furnishing a bail bond Rs. 50,000/- (rupees fifty thousand) with two sureties of the like amount to the satisfaction of the learned Trial Court. 7. It is further provided that the petitioner shall cooperate with the trial and he shall not try to intimidate or influence any witnesses acquainted with the facts of this case, in any manner. 8.
