This application has been directed against the order dated 05.01.2026 passed by the learned Additional Sessions Judge 1st cum Children Court, Deoghar in Criminal (Juvenile Bail) Appeal No. 40 of 2025 whereby and whereunder the order dated 28.11.2025 passed by the learned Principal Magistrate, Juvenile Justice Board, Deoghar in connection with Enquiry No. 227 of 2025 arising out of Jasidih P. S. Case No. 217 of 2025 rejecting the prayer for bail of the petitioner has been affirmed. Submission has been advanced by the learned counsel for the petitioner that initially there was no allegation that the petitioner has established physical relationship with the victim, but subsequently in her statement recorded under Section 180 B.N.S.S., the victim has stated that on the allurement of marriage, the petitioner had established physical relationship with her on several occasion. He has further submitted that the petitioner is in observation home since 27.08.2025. It has also been submitted that social investigation report is not adverse to the cause of the petitioner. Learned A.P.P. for the State has opposed the prayer for bail of the petitioner. -2- The allegation reveals that the daughter of the informant did not return from college and in course of search, it was detected that she was seen with the present petitioner and on a search conducted, the petitioner could not be located. Subsequently, when the petitioner was confronted, he had disclosed that the daughter of the petitioner is at Andal Station after which the informant went to Andal Station and brought back the victim. The petitioner as has been noted above is in custody since 27.08.2025. Nothing adverse has been stated as to the family background or the conduct of the petitioner in the social investigation report.
