1. Heard Ms. R. Choudhury, the learned senior counsel, assisted by Mr. R. Islam, the learned counsel for the petitioner. Also heard Ms. A. Begum, the learned Additional Public Prosecutor appearing for the State of Assam as well as Mr. A.S. Choudhury, the learned counsel for the respondent No. 2.

This is an application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 praying for grant of bail to the accused- applicant, namely, Nur Nabi Mollah, in connection with Lakhipur P.S. Case No. 106/2026, under Section 72(2)/351(2) of BNS read with Section 12 of POCSO Act, 2012, (corresponding to GR Case No. 566/2026).
3. Case Diary as called for has been received.
4. Upon perusal of the same, as well as statement of the victim recorded under Section 183 BNSS, 2023, I am of the view that further custodial detention of the petitioner is not necessary. Accordingly, the prayer for bail is allowed.
5. Therefore, it is directed that the above-named accused- applicant shall be released forthwith from the judicial custody on furnishing a bail bond of Rs.20,000/- (Rupees Twenty Thousand) only with two local sureties of like nature, at least one of whom should be a Government servant, to the satisfaction of the learned Special Judge, (POCSO), Goalpara, subject to the following conditions: - (i) That the accused-applicant shall appear before the Trial Court as and when required; (ii) The accused-applicant shall not hamper or tamper with any evidence or influence any witnesses connected with the case.

6. Accordingly, the instant bail application is disposed of as allowed.
