The Court made the following Order:
Petitioner is aggrieved by the order dated 02.01.2025 of the learned trial Court in Crl.M.P.No.2336 of 2025 in Crime No.171 of 2024 filed the instant writ petition seeking Mandamus.
2. It is submitted by the learned counsel for the petitioner that the entire money of Rs.37,00,000/- was seized in connection with the crime case, out of which, Rs.12,00,000/- was already released in favour of the present petitioner. Rs.25,00,000/- was given in custody to the Principal Director of Income Tax (Investigation), Hyderabad by impugned order. Such order and direction of the learned trial Court fixing a condition to furnish a bond of Rs.25,00,000/- by the Principal Director of Income Tax (Investigation) is challenged by the petitioner.
3. Such direction is upon the Principal Director of Income Tax (Investigation) and not upon the present petitioner. Hence, I find petitioner is not aggrieved person. Writ Petition by party, who is not aggrieved, is not maintainable.
4. On the above observation, the instant Writ Petition is closed. There shall be no order as to costs.
As a sequel, pending miscellaneous applications, if any, shall stand
