JUSTICE M.NAGAPRASANNA ORAL ORDER In Crl.P.No.3727/2026, petitioners – accused Nos.1 to 4 are before this Court calling in question proceedings in C.C.No.51895/2024, pending before the XI Additional Chief Judicial Magistrate, Mayohall, Bengaluru, for the offences punishable under Sections 354D, 504, 506 and 34 of the IPC and in Crl.P.No.5394/2026, the petitioners – accused Nos.1 to 4 are calling in question proceedings in C.C.No.66157/2024, pending before the 11th Additional Chief Judicial Magistrate, Mayohall, Bengaluru, for the offences under Sections 504, 498A, 506 r/w. 34 of the IPC and Sections 3 and 4 of the Dowry Prohibition Act. 2. Learned counsel for the petitioners and respondent No.2 in the respective petitions would submit that the parties to the lis have settled their matrimonial dispute amicably before the concerned Court by drawing up certain terms and conditions. Therefore, they are before this Court seeking permission to compound the offences. The parties have filed a certified copy of the joint affidavit filed before the concerned - 6 - HC-KAR NC: 2026:KHC:18880 CRL.P No. 3727 of 2026 C/W CRL.P No. 5394 of 2026 Court in C.C.No.51895/2024 and a joint affidavit in Crl.P.No.5394/2026, filed before this Court to that effect. 3. Learned counsel for petitioners submits that a demand draft of Rs.5/- lakhs is paid to the wife and the same is acknowledged by the complainant – wife. 4. The joint affidavit filed in C.C.No.51895/2024 reads as follows: “4. I, Indumati Senapati, the second Respondent in the above case state that in view of the harmonious relationship developed by settling all the disputes, I being the complainant doesn't want to prosecute the case and if the proceedings are allowed to continue it will hamper our respective life. The said compromise has occurred out of my free will and consent. I have taken this decision after much deliberation. I want to withdraw all the allegations. Hence, I pray to close this case. I say that this court may be pleased to permit me to withdraw all the allegations in Cr. No. 123/2023 (Ramamurthy Nagar Police Station) subsequently numbered as CC No. 51895/2024 for offences 354(D), 504 & 506 r/w 34 IPC. 5. Therefore, we humbly submit to this Hon'ble Court to kindly quash the entire proceedings in CC. No.51895/2023 pending on the file of XI ACJM, Mayohall, Bengaluru City in the interest of justice and equity. 6. We state that, we being consenting adults have entered into this affidavit out of our free will and volition without any coercion and force from anybody. - 7 - HC-KAR NC: 2026:KHC:18880 CRL.P No. 3727 of 2026 C/W CRL.P No. 5394 of 2026 7. We all further state that we shall not take any action against each other on conclusion/closure of this case, on the same cause of action and same subject anytime in future and the matter stands closed. 8. We state that and verify that all averments made in this Joint Affidavit are true and correct to the best of our knowledge, information and belief.” The joint affidavit filed in Crl.P.No.5394/2026 reads as follows: “4. I, Ratnala Sravani, the second Respondent in the above case state that in view of the harmonious relationship developed by settling all the disputes, I being the complainant doesn't want to prosecute the case and if the proceedings are allowed to continue it will hamper our respective life. The said compromise has occurred out of my free will and consent. I have taken this decision after much deliberation. I want to withdraw all the allegations against the Petitioners 1 to 4. I say that this court may be pleased to permit me to withdraw all the allegations in Cr No 7/2023( East Women Police Station subsequently numbered as CC 66157/2024 for offences 498(A), 504, 506 R/w 34 IPC, 3 & 4 DP Act. Hence, I pray to close this case. 5. Therefore, we humbly submit to this Hon'ble Court to kindly quash the investigation and the entire proceedings in CC. No. 66157/2024 pending on the file of XI ACJM, Mayohall, Bengaluru City in the interest of justice and equity. 6. We state that and verify that all averments made in this Joint Affidavit are true and correct to the best of our knowledge, information and belief.” In the light of the fact that the parties have arrived at settlement and since it is a marital dispute, I deem it appropriate to accept the terms of the joint affidavits and terminate the proceedings against the petitioners in both the petitions, as the allegations are not against the State. 5. For the aforesaid reasons, I pass the following: ORDER (i) The criminal petitions are disposed. (ii) The proceedings in C.C.No.51895/2024, pending before the XI Additional Chief Judicial Magistrate, Mayohall, Bengaluru, for the offences punishable under Sections 354D, 504, 506 and 34 of the IPC impugned in Crl.P.No.3727/2026 and the proceedings in C.C.No.66157/2024, pending before the 11th Additional Chief Judicial Magistrate, - 9 - HC-KAR NC: 2026:KHC:18880 CRL.P No. 3727 of 2026 C/W CRL.P No. 5394 of 2026 Mayohall, Bengaluru, pending before the 37th Additional City Civil and Sessions Judge, Bengaluru, impugned in Crl.P.No.5394/2026, stand quashed.
