Bina Devi Respondent No. 6 to 10 are the sons and daughter of Late Tapeshwar Prasad Sahu, Resident of Village Burmu, P.O. & P.S. Burmu, District Ranchi (Jharkhand. … Respondents. ------- CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Ms. Rajshree Sinha, Advocate For the Respondents : Mr. Ashutosh Anand, AC to AAG-III ------ 02/ 14.05.2026: By filing this writ application, the petitioner prays for a direction upon the respondent No.5 not to proceed in the Mutation Case No.1233 of 2025-2026, (Bina Devi & Others Vs. Sulender Goswami), during the pendency of C.M.P. (Filing) No.3828 of 2026 (arising out of S.A. No.60 of 2017). 2. It is the grievance of the petitioner that in spite of pendency of second appeal being S.A. No.60 of 2017 filed by the petitioner the authorities are proceeding with the mutation proceeding. 3. Considering the submission of the parties, I am of the opinion that pendency of the Second Appeal cannot be a bar in proceeding with the mutation proceeding by the authorities as the State also needs to recover rent from a person who is occupying the land in question. 4. It is made clear once the second appeal is disposed, the authorities will reconsider their decision based on the judgment passed in the Second Appeal. 5. With the aforesaid observations and directions, this writ petition is disposed of. (ANANDA SEN, J.) 14th May, 2026 Madhav/- Uploaded on:16/05/2026
