The present petition is filed alleging willful and deliberate violation of this court’s order dated 28.02.2028 passed in WP(C) No. 6500/2017. By the aforesaid order, the respondents were directed not to deduct the excess salary received by the petitioner for the period he served the Institution Page No.# 3/3 beyond his actual date of superannuation and also directed to the respondents to proceed for payment arriving at a conclusion as to whether enhanced pay was given to the petitioner for any fault of his own or not. Mr. SMT Chistie, learned counsel for the respondent Nos. 1,3,4,5 and 6 submits that the pension of the petitioner has been regularized by the Director of Pension vide letter No. Pen:ADP/PPO/GPO/2016-17/067428 dated 18.08.2020 and he has been released his due. Mr. B Deori, learned counsel is also present representing the respondent No. 2. In view of the aforesaid, more particularly, in view of the absence of the petitioner, this court is of the opinion that the petitioner is not interested in pursuing this contempt petition.
