... Applicant versus 1 - State Of Chhattisgarh Through Station House Officer, Police Station Kasdol, District- Balodabazar- Bhatapara (C.G.)
... Respondent For Applicant : Mr. Anchal Kumar Matre, Advocate For Respondent : Mr. Afroz Khan, P.L. Hon'ble Shri Justice Sanjay Kumar Jaiswal Order On Board 30/03/2026
1. This is the first bail application filed u/s 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 620/2025 registered at Police Station Kasdol, District Balodabazaar- Bhatapara (CG) for the offence punishable under Sections 127(1), 296(b), 351(3), 74 of BNS and Section 8 of POCSO Act. 2. As per the prosecution's case, it is alleged against the present applicant that on 05.10.2025, the applicant restrained the minor victim with the intent to outrage her modesty by holding her hand and touching her inappropriately in a public way at about 2:00 HEERA LAL SAHU Digitally signed by HEERA LAL SAHU Date: 2026.03.30 17:50:23 +0530
2 pm. It is also alleged that the applicant used filthy language against her and also threatened her. Based on this, offence has been registered against the present applicant. 3. Learned counsel for the applicant submits that the applicant has been falsely implicated in the present case. The same prosecutrix has also filed another FIR against the present applicant, which was registered as FIR No. 626/2025, dated 10.10.2025, for the incident dated 17.09.2025 at the same police station. It is pertinent to mention that after 5 days, the above-mentioned FIR was lodged at the same police station and investigated by the same I.O. It is also important to note that no whisper of a prior incident, which took place on 17.09.2025, has been made while lodging the present FIR. The present applicant has been falsely implicated under the influence of one Baleshwar vaishnav who happens to be a member of the Jila Panchayat, who had attempted to murder with some boys belonging to the village Devrikhurd.
The present applicant was implicated because, being the Jila Adhyaksh of Bhim Army, he was involved in a protest against the said Baleshwar, who belongs to the ruling party and has a politico- social rivalry with the applicant. The applicant, on the date of the incident i.e. 05.10.2025, was present at the protest which was organised outside P.S. Kasdol seeking the arrest of Baleshwar Vaishnav. He also submits that the applicant is in jail since 06.10.2025, and there is no likelihood of the trial being concluded at the earliest. Hence, considering all these facts, the applicant may be released on bail. 3
4. Learned State counsel, on the other hand, opposing the bail application, submits that the victim was a minor at the time of the incident and she has supported the case of prosecution. Only 2 witnesses out of 12 witnesses have been examined till date; some important witnesses have yet to be examined. Therefore, considering the nature of offence, at this stage, the applicant does not deserve to be released on bail. 5. The parents of the victim is present in person before this Court today and recorded no objection to grant of bail to the applicant. 6. Heard learned counsel for the parties and perused the case diary. 7. Taking into consideration the entire facts and circumstances of the case, particularly the nature and gravity of the offence and the material collected and available on record against the applicant, without commenting on the merits of the case, at this stage, this Court is not inclined to release the applicant on bail. 8. Accordingly, the present bail application stands rejected. 9. Office is directed to send a certified copy of this order to the trial Court concerned for necessary information.
