The Court made the following Order:
The petitioner, aggrieved by the inaction on the part of respondent No.2 in passing appropriate orders on the petition dated 17.02.2025 filed under Section 23(1) of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, filed the present Writ Petition. 2. Learned counsel appearing for the petitioner submits that the petitioner is a senior citizen and has invoked the Act against respondent Nos.3 and 4 seeking the relief of cancellation of the registered Gift Settlement Deeds executed by the petitioner in favour of respondent Nos.3 and 4. 3. It is the specific case of the petitioner that the petitioner had executed a Gift Deed in favour of his daughter, respondent No.3, by transferring right, title and interest over land admeasuring Ac.5.79 cents and another in favour of his son-in-law, respondent No.4, over land admeasuring Ac.1.15 cents.
It is also the case of the petitioner that the petitioner has been neglected by respondent Nos.3 and 4 and, as such, has filed the complaint by invoking the Maintenance and Welfare of Parents and Senior Citizens Act, 2007. It is submitted that though the petition was filed on 17.02.2025 before respondent No.2 and pleadings are completed, however, respondent No.2, so far, has not decided the petition filed by the petitioner. 4. Learned Assistant Government Pleader appearing for respondent Nos.1 and 2 submits that the application for maintenance under Section 5(1) has to be decided within three (3) months. However, the claim of the petitioner under Section 23(1) is to be decided by respondent No.2. 4
5. Considering the submissions, the Writ Petition is disposed of directing respondent No.2 to dispose of the petition submitted by the petitioner as expeditiously as possible, preferably within a period of three (3) months from the date of receipt of a copy of this order, by offering an opportunity of hearing to the petitioner as well as the unofficial respondents. ____________________ JUSTICE HARINATH.N 28.09.2026 RSD
