ORAL ORDER After addressing the arguments for some time, learned counsel for the revision petitioner has filed a memo. Counsel for the respondent is absent. Respondent - Smt. Anushree @ C. Anita is present. She has endorsed no objection on the memo.
2. Memo reads as under:
“The petitioner in the above petition submits that out of fine amount of Rs.10,00,000/-(Ten Lakhs), the petitioner has already paid an amount of Rs.5,30,000/- (Five Lakhs Thirty Thousands) to the Respondent and liable to pay an amount of Rs.4,70,000/- (Four Lakhs Seventy Thousand only). Out of fine amount and the petitioner undertakes to pay the same within four months i.e., on or before

31st July 2026 and prays to acquit the petitioner, hence this memo in the interest of justice.”
3. Placing the memo on record, petition stands
disposed of.
4. Amount in deposit is ordered to be withdrawn by the complainant under due identification.
5. It is made clear that if the compensation amount as agreed in the memo is not paid, petitioner shall under go imprisonment as ordered by the learned Trial Magistrate, confirmed by the First Appellate Court.
6. After payment of the entire compensation amount as agreed in the memo, a sum of Rs.5,000/- imposed by the learned Trial magistrate towards defraying expenses of the state is set aside. Sd/- (V SRISHANANDA) JUDGE
