The petitioners are aggrieved of the sealing of Bhargav Arms Company, and the seizure of the articles therein, in terms of Order No. 1212- 18/ARMS/DMJ/24 dated 16.11.2024 passed by the District Magistrate, Jammu. By virtue of the said order, certain items including chairs, tables, air-conditioners, 16 bore gun cartridges, CCTV cameras and ceiling fans have been seized. 02. The petitioner has sought release of the seized articles and a direction to the respondents to consider the representation filed by the petitioner seeking de-sealing of the company premises, situated at Shiv Mandir Market, Railway Station, Jammu, which, according to the petitioner, has been sealed arbitrarily and that in terms of Section 21 of the Arms Act, 1959 and the Rules framed thereunder, the seized items can be released in favour of a licensed dealer. 03. Learned counsel for the petitioners submits the petitioners would be satisfied in case the present petition is disposed of at this stage with a Serial No. 05 2 direction to respondent No. 2 – District Magistrate, Jammu, to consider and decide the representation dated 15.01.2026 filed by the petitioner, in the light of the statutory provisions and such material as may be supplied by the petitioner. 04. Learned counsel for the respondents who is present before this Court submits that the respondents are not averse to the plea raised by the learned counsel for the petitioners for consideration of the matter, in accordance with law. 05. Having regard to facts and circumstances of the case and submission on behalf of petitioners, without expressing any opinion on the merits of the case, the present petition is disposed of at this motion stage with a direction to respondent No. 2 – District Magistrate, Jammu, to consider and decide the aforesaid representation dated 15.01.2026 in accordance with law, within a period of six weeks from the date a copy of this order, along with a copy of the representation and relevant documents, is furnished to him. 06.
