2026:JHHC:7042 IN THE HIGH COURT OF JHARKHAND AT RANCHI
B.A. No.11909 of 2025 Dhiraj Kumar Mishra @ Dhiraj Mishra, son of Santosh Mishra, resident of village Pandeypur, P.O and P.S- Sikraul, District- Buxar, Bihar. … Petitioner(s). -Versus- The State of Jharkhand
… Opp. Party(s). ------ CORAM :
SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Aman Dayal Singh, Advocate. For the State : Mr. Pankaj Kr. Mishra, A.P.P. ------ 03/16.03.2026: This bail application has been filed under Sections 483 & 484 of BNSS, 2023 wherein, prayer has been made for grant of bail as the petitioner is in custody for allegedly committing offence punishable under Section(s) 109, 103(1), 61 and 3(5) of BNS and under Section(s) 25(1-B) (a) and 27 of the Arms Act. 2. Heard, learned counsel for the parties and have gone through the impugned order. 3. Learned A.P.P opposes the prayer for bail of the petitioner. 4. There is allegation that the husband of the informant was shot dead. 5. As per the FIR, the suspicion is casted upon one Raghvendra Singh @ Vikash Singh and his brother Guddu Singh. This petitioner is not named in the FIR nor there is any suspicion against him. 6. During course of investigation, two co-accused. namely, Satyam Pathak and Rahul Kumar Jaiswal were arrested, who in their confessional statement stated that it is this petitioner, who conspired to commit murder of the deceased. Except the confessional statement, there is no other materials to connect this petitioner with this crime. Admittedly, there no recovery of any incriminating articles from this petitioner and it is stated that during Durga Puja, some difference had taken place between the petitioner and the deceased, which may be the cause of the incident. 7. Further from the case diary, I find that the dispute arose between the petitioner and the deceased during the Durga Puja of the year 2018. The proximity of the date of the incident, which occurred on 7.7.2024, and the dispute is quite wide enough, which, prima facie, cannot be said to be a ground for committing the murder of the deceased. Though there is some incident but as noticed earlier, there are no other materials against the petitioner to connect him with this crime, save and except the confessional Page No. 1
