JUSTICE S.R.KRISHNA KUMAR ORAL ORDER In this petition, petitioners seek the following reliefs: “i) Issue a writ of mandamus, order or direction directing the respondent No.4 not to exercise the statutory functioning of the post of Dean and Director of Chamarajanagar Institute of Medical Sciences, till finalization of the selection and appointment to the post of Dean and Director on regular basis to the 3rd Respondent Institute. ii) Direct the respondents 1 and 2 to consider the representation submitted by the petitioner dated 06.05.2025 (vide Annexure-H) and to finalise the selection process to the post of Dean and Director of the 3rd respondent Institute, in - 4 - HC-KAR NC: 2026:KHC:15634 WP No. 16375 of 2025 terms of the bye-laws of the Institute (vide Annexure-A); within a time frame specified by this Hon’ble Court. iii) Pass such other order as this Hon’ble Court deems fit in the facts and circumstances of the case.” 2. Heard learned counsel for the petitioners and learned AGA for respondent No.1 and learned counsel for respondent Nos.2 to 4 and perused the material on record. 3. A perusal of the material on record will indicate that on 19.02.2026, this Court passed the following order: “I.A.No.1/2026 is filed seeking modification of the order dated 03.02.2026. Learned counsel for the petitioner submits that this Court, by order dated 03.02.2026, had directed respondent No.4 not to take any financial decision in respect of respondent No.3–Institution till the next date of hearing. The said interim direction was issued in view of the earlier order dated 25.03.2025 passed in W.P. No.24471/2024, wherein this Court had directed the respondent–State to finalize the amendments to the C & R Rules and not to continue the Additional Charge arrangement on a temporary basis. It is submitted that the said direction had not been complied with. Therefore, this Court has granted interim order dated 03.02.2026. Today, the learned Additional Advocate General has filed a memo enclosing documents to indicate that the - 5 - HC-KAR NC: 2026:KHC:15634 WP No. 16375 of 2025 Finance Department has approved and finalized the C & R Rules. It is submitted that the Rules will be registered within seven days from today and that applications to the post of Director (Regular) will be invited on or before 15th March 2026. It is further submitted that the entire selection process will be endeavoured to be completed within three months thereafter. The submission of the learned Additional Advocate General is taken on record. In view of the above developments, the order dated 03.02.2026 is modified. Respondent No.4 is permitted to take financial decisions in respect of respondent No.3– Institution, in accordance with law. Accordingly, I.A. No.1/2026 stands disposed of. List this matter on 16.03.2026.” 4. In pursuance of the said order, the respondent-State have issued a Notification dated 12.03.2026 inviting applications for the post of the Director and a Communication dated 12.03.2026 for the purpose of paper publication of the said Notification. The said documents are filed with a memo of even date by the respondent- State and the same are placed on record. 5. In view of the aforesaid facts and circumstances, I deem it just and appropriate to dispose of this petition directing the respondent-State to complete the selection and appointment - 6 - HC-KAR NC: 2026:KHC:15634 WP No. 16375 of 2025 process to the post of the Director in terms of the Notification dated 12.03.2026 within a period of three months from today. 6. Subject to the aforesaid observations and directions, the petition stands disposed of. 7.
