The petitioner is apprehending his arrest in connection with Govindpur P.S. Case No.573 of 2025 for the alleged offences registered under Sections 281, 125(A), 125(B), 109 and 3(5) of Bharatiya Nyaya Sanhita, 2023 pending in the Court of learned Judicial Magistrate 1st Class, Dhanbad. 3. Learned counsel appearing for the petitioner submits that the petitioner has been falsely implicated in this case and the allegations are made of hitting the father of the informant by motorcycle. He further submits that the written report of informant has been recorded in paragraph No.59 of the case diary. On these grounds, he submits that anticipatory bail may kindly be granted. 4. Learned counsel appearing for the State opposed the prayer and submits that in paragraph No.59 of the case diary the informant 2026:JHHC:14739 --2-- A.B.A. No. 1180 of 2026 has only rectified the date of the vehicle accident. On this ground, he submits that anticipatory bail may kindly be rejected. 5. In the FIR it has been alleged that on 04.12.2025 there is some altercation and on 05.12.2025 with intention to retaliate, the petitioner has again came back and dashed the father of the informant, who was treated in RIMS and subsequently he has died. In paragraph No.59 of the case diary the informant has only rectified that the said alleged act has been done by the petitioner on 05.12.2025 and not on 04.12.2025, however, he has further stated in the said paragraph that intentionally the petitioner has hit the father of the informant by motorcycle and subsequently during treatment he has died. Alleged occurrence is said to be dated 04.12.2025 and again the petitioner has came back on 05.12.2025 and hit the father of the informant by the motorcycle. 6. In the attending facts and circumstances, I am not inclined to grant privilege of anticipatory bail to the petitioner, hence, the prayer for anticipatory bail of the petitioner is hereby rejected.
