Case No.708 of 2025 dated 05.11.2025 under Sections 318(2), 318(4), 336(2), 340(2) and 61(2) of the BNS, 2023. And In the matter of: Subham Gupta … petitioner Mr. Mayank Roy … for the petitioner Mr. Abhijit Sarkar Ms. Namrata Das … for the State Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. During pendency of this application, a notice under Section 35(3) of the BNSS was issued, which was complied with. Learned counsel for the State strongly opposes the prayer for anticipatory bail and submits that the petitioner is the kingpin behind a racket which prepared forged birth certificates. Apart from the statement of the co-accused made before the learned Magistrate, there are phone call records and money trail to connect the present petitioner with the principal accused. Moreover, there are elements of Section 338 of the BNSS. Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail. The application for anticipatory bail is, thus, rejected. 2 Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
