JUSTICE S.R.KRISHNA KUMAR - 3 - HC-KAR NC: 2026:KHC:13708 WP No. 7488 of 2026 ORAL ORDER In this petition petitioner seeks the following reliefs: "a) Issue writ in the nature of Certiorari or any other Writ or Order or Direction in the similar nature quashing the Impugned Order of Transfer dated 02.03.2026 bearing No.U.A(A)Ben.Pa.Na.Paa/PR/314/A/2025-26 vide Annexure-E passed the 3rd respondent authority; b) Issue a Writ in the nature of Mandamus or any other Writ or Direction in the similar nature directing the respondent authorities to consider the representation dated 29.11.2025 vide Annexure-C and representations dated 20.02.2026 vide Annexure-C1 to C4 and take appropriate steps for tracing the Service Book of the petitioner expeditiously; c) Grant such other relief or relief's as this Hon'ble Court may deems fit to grant in the facts and circumstances of the case, in the interest of justice and equity." 2. Though several contentions have been urged by both sides in support of their respective claims, having regard to the fact that the petitioner has not submitted her reply to the show cause notice dated 02.03.2026, without - 4 - HC-KAR NC: 2026:KHC:13708 WP No. 7488 of 2026 expressing any opinion on the merits/demerits of the rival contentions, I deem it just and appropriate to dispose of this petition by issuing certain directions. Hence, the following: ORDER (i) Petition is hereby disposed of. (ii) The petitioner shall submit a reply to the show cause notice dated 02.03.2026 issued by the respondent within a period of four weeks from today together with all relevant documents. (iii) Upon the petitioner submitting reply along with documents to the aforesaid show cause notice dated 02.03.2026 issued by the respondents, the respondents shall consider the same and provide sufficient and reasonable opportunity to the petitioner and hear her and pass appropriate orders/take appropriate decision within a period of two months from the date of receipt of copy of this order. (iv) In addition there to, the respondents shall also consider and pass appropriate orders - 5 - HC-KAR NC: 2026:KHC:13708 WP No. 7488 of 2026 on the representation at Annexures-C1 to C4 and take appropriate steps in this regard within a period of two months from the date of receipt of copy of this order. (v) It is further directed that the impugned transfer order would be subject to the respondent reconsidering the transfer order after passing appropriate orders pursuant to the show cause notice.
