This is an application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, praying for granting bail to the accused-applicant in connection with Dhubri Police Station Case No. 252/2026 (corresponding to G.R. No. 783/2026) under Sections 61(2)/318(2)/ 336(3)/148/3(5) of the Bharatiya Nyaya Sanhita, 2023. 3. An FIR was lodged on 07.07.2026 by one Raju Roy, Building Inspector before the Officer-In-Charge of Dhubri Police Station, alleging, inter-alia that the informant is a Building Inspector in the Office of Chairman, Dhubri Gauripur Development Authority. It is alleged that on 07.07.2026 at about 11.00 AM, during scrutiny of office records, the NOC for sale of land submitted by one Amzad Hussain, was found suspicious. The signature purportedly of the Chairman and the NOC’s format displayed anomalies and the memo number did not match with their office register. It is alleged that on calling Amzad Hussain to the office, he stated that the accused No. 1 and the accused No. 2 had supplied the forged NOC instead of the original after accepting Rs.57,500/- (Rupees Fifty Seven Thousand and Five Hundred) from the informant. It is alleged that both the accused persons told him that the NOC was original and genuine. It is alleged that the accused persons have created false documents and forged signatures for wrongful gain, affecting Government records and revenue. It is alleged that similar illegal activities appeared to have been carried out by the same persons for past 6-7 months and the criminal nexus created a mammoth forgery and also cheated gullible people. It is alleged that these offences strike at the national interests and the economy of the State, which is against the Nation. Page No.# 3/4

On receipt of the FIR, the Police registered Dhubri Police Station Case No. 252/2026 under the aforementioned Sections. 5. The learned Senior counsel appearing for the accused-applicant submits that the accused-applicant is in fact not involved in the alleged offence as narrated in the FIR. He submits that he is a person who works with the other accused person, namely Faruk Sk, and he has not committed any offence. He further submits that the accused-applicant is behind the bars for last 42 (Forty Two) days and the Section 148 of BNS, which is being registered against him, is not applicable in the instant case. He submits that taking into account the aforesaid facts, the accused-applicant should be granted bail at this stage. 6. On the other hand, Mr. R.J. Baruah, the learned Additional Public Prosecutor, submits that the main accused, Mr. Faruk Sk, is yet to be apprehended and the investigation is still going on. He submits that there are sufficient incriminating materials against the accused-applicant of his involvement in the instant case. 7 The Case Diary in the instant case has been produced and the same is perused. 8. Taking into account the entire facts of the case and having found sufficient prima facie incriminating materials against the accused-applicant, this Court is not inclined to grant any bail to the accused-applicant at this stage. 9. Accordingly, the instant Bail Application is rejected. Page No.# 4/4
