Heard Mr.Pankaj Singh, learned counsel for the petitioner as well as Mr.Prasoon Bhaduri, learned Deputy Advocate General appearing for respondent No.1 to 4/State. 2. By way of this writ petition under Article 226 of the Constitution of India, the petitioner has prayed for following reliefs:- “A. To quash/set aside the purported Notice Inviting Tender, floated by Respondent No. 3 / Civil Surgeon cum CHS for the year 2023-24 in respect to operation of canteen in the premises of District Hospital, Baikunthpur and the consequent processes undertaken therein which culminated in award of tender to private respondent herein; and B. To quash/ set aside the impugned order dated 16.05.2023, issued by the Respondent No. 3/Civil Surgeon cum CHS and all consequences arising thereof and related thereto; and C. To permit/allow the Petitioner to run the canteen concerned without interference and obstruction of whatsoever nature; and D. To direct an inquiry into the impugned conduct of the Respondent No. 3 / Civil Surgeon cum CHS; and E. To direct the Respondent State to adequately compensate the Petitioner for loss of good-will; and F. To award cost of the present litigation to Petitioner; and/or 3 G. Any other relief(s) in favor of Petitioner as this Hon'ble Court may deem fit and proper under the facts and circumstances of the case.” 3. Learned counsel for the petitioner submits that this writ petition has become infructuous as the subject tender has been lapsed. 4.
