By way of the present execution petition which was filed in the year 2025, the petitioner is seeking compliance of the judgment passed by this Court on 28.04.2016 in CWP No.1081 of 2016, titled Dharam Chand vs. State of H.P. and others, along with connected petitions. 2. The reply as such of respondents No.3 and 4 is that an 1 Whether reporters of Local Papers may be allowed to see the judgment? 2 allotment has already been made on 29.07.2020, whereby the petitioner has been allotted 23.5 bighas of land in 79/08 of Chak 3 DDSM of Sub-Colonization Tehsil M-1, having been declared eligible as a Pong Dam oustee. The allocation order has to be issued separately. 3. Now, in rejoinder as such, a contention is sought to be raised that it is not in accordance with the Memorandum of Understanding arrived at between the two States and the allocation should be done in the first phase of District Sri Ganganagar out of the reserved land of 2.20 lakh hectares. 4. We are of the considered opinion that substantial compliance as such of the judgment, which is sought to be executed, has been done and the petitioner has approached this Court at a belated stage in the execution proceedings and now cannot shift the blame upon the respondents that he was not aware of the allotment. 5. If the petitioner is aggrieved by the allocation of the land, it is always open for the petitioner to file an appropriate petition to establish a cause of action as to whether the order of allocation not in District Sri Ganganagar is justified or not. 3
6. The present petition is accordingly disposed of with the aforesaid observations. Pending miscellaneous application(s), if any, shall also stand disposed of.
