Das, learned Additional Public Prosecutor for the opposite party no. 1; and Ms. M. Deka, learned counsel for the opposite party no. 2. 2. The instant interlocutory application is preferred by the applicant seeking corrections at certain places in an Order dated 07.01.2026 passed by this Court in Criminal Petition no. 1582/2025 projecting the same as typographical errors. 3. The applicant as the petitioner has preferred the accompanying Criminal Petition no. 1582/2025 assailing an Order dated 10.08.2023 passed in the complaint case, C.R. no. 136/2023 passed by the Court learned Judicial Magistrate, First Class, Jorhat and also seeking quashing of the proceedings of P.R. Case no. 134/2025 registered under Section 384, Indian Penal Code and presently pending before the Court of learned Judicial Magistrate, First Class, Jorhat. 4. When the criminal petition was moved on 07.01.2026, this Court while issuing notice making the notice returnable on 16.02.2026, passed an interim order suspending further proceedings of P.R. Case no. 134/2025 till the returnable date. 5. In the interlocutory application, it is averred that at two places in paragraph 3 and in paragraph 8 of the Order dated 07.01.2026, it is typed as ‘the Court of Judicial Magistrate, First Class, Kamrup’ instead of ‘the Court of Judicial Magistrate, First Class, Jorhat’. At paragraph 4 of the Order dated 07.01.2026, ‘Section 528, CrPC’ has been typed instead of ‘Section 528, BNSS’. 6. The learned counsel for the opposite parties are also in agreement that the errors which had occurred are typographical errors. Page No.# 3/3 7. As the errors, mentioned above, which are discernibly typographical errors, the instant interlocutory application is allowed. 8. It is made clear that at paragraph 2 and paragraph 4 of the Order dated 07.01.2026, the words appearing as ‘the Judicial Magistrate, First Class, Kamrup’ are to be read as ‘the Judicial Magistrate, First Class, Jorhat’ and at paragraph 4 of the Order dated 07.01.2026, the words appearing as ‘Section 528, CrPC’ are to be read as ‘Section 528, BNSS’. It is also ordered that this order, for all intents and purposes, should be treated as part and parcel of the Order dated 07.01.2026 passed in Criminal Petition no. 1582/2025.
