This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No. 585/2025 registered at Police Outpost- Sonakhan, Police Station - Kasdol, District - Balodabazar-Bhatapara (C.G.) for the offence punishable under Sections 4, 6, 10 and 11 of the Chhattisgarh Agricultural Cattle Preservation Act, 2004 and Section 11(1)(d) of Prevention of Cruelty to Animals Act, 1960 and Section 111 of Bharatiya Nyaya Sanhita, 2023.
2. The prosecution story, as it appears from the charge-sheet, is that the police recorded the disclosure statement of Mansoor, who was the driver of vehicle bearing registration No. CG-04-PS-7678. He stated that on PREETI KUMARI Digitally signed by PREETI KUMARI Date: 2026.01.06 10:45:42 +0530
2 09.09.2025, in the morning, the present accused/applicant, Islam Qureshi, sent him along with Sakib Mohammad in the said vehicle to Baloda Bazar, from where they were to load cattle and transport them to Batora Bazar, Odisha, for slaughter. Identical statements were given by the co-accused Sakib Mohammad, Deepak Patle, Shiv Kumar Sagar, and Bhagwat Kashyap. On the basis of these disclosure statements, the applicant has been implicated in the crime. The applicant is innocent and has committed no offence.

Learned counsel for the applicant has argued that the applicant is innocent and has been falsely implicated in the present case. It is submitted that the name of the applicant has come to light only in the memorandum statements of the co-accused, and he has two previous criminal antecedents, which are old and stale. Therefore, learned counsel prays for the grant of anticipatory bail to the applicant.
4. On the other hand, learned State counsel opposes the bail application. She further submits that the applicant has two previous criminal antecedents, therefore he is not entitled for grant of bail.
5. I have heard learned counsel for the parties and perused the materials available on record.

Considering the facts and circumstances of the case, the nature and gravity of the allegations leveled against the applicant, and the fact that the name of the applicant has come to light only in the memorandum statements of the co-accused, and so far as the criminal antecedents of the applicant are concerned, he has two previous criminal antecedents which are old and stale, this Court is of the view that the applicant is entitled to be granted anticipatory bail in the present case.

Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant –Islam Qureshi on executing a personal bond with one surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) The Applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade his from disclosing such fact to the Court. (b) The Applicant shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The Applicant shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d)The Applicant and the surety shall submit a copy of their adhaar card alongwith a colored postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
