Order 24/08/2026
1. The present bail application has been filed on behalf of the accused-applicant under Section 483 of the B.N.S.S, 2023 against the order dated 04.07.2026 passed by learned Additional Sessions Judge, Sawai Madhopur in Bail Application No. 614/2026, arising out of FIR No. 139/2026, registered at Police Station Mantown, District Sawai Madhopur for the offences punishable under Sections 304(2), 3(5) & 115(2) of BNS, 2023, by which the bail application of the accused-applicant under Section 483 of the B.N.S.S, 2023 was dismissed.
2.
Learned counsel for the accused-applicant submits that the accused-applicant has falsely been implicated in this matter. It is submitted that the charge-sheet has been filed for the offences
[2026:RJ-JP:34363] (2 of 3) [CRLMB-12432/2026] punishable under Sections 115(2), 304(2) and 61(2)(a) of BNS,
2023. Learned counsel argues that the offences levelled against the accused-applicant are triable by a Judicial Magistrate. Learned counsel also argues that the accused-applicant was arrested on 01.05.2026 and since then, he is behind the bars. Learned counsel contends that the other co-accused persons, namely, Vikas, Gulshan and Sarita have already been granted bail by the learned trial Court, whereas the bail application of the present accused- applicant has been dismissed as the other criminal cases are registered against him. Learned counsel prays that the charge- sheet has been filed and the trial will take a long time to conclude; therefore, the accused-applicant be enlarged on bail.
3. On the other hand, learned Deputy Government Advocate opposes the bail application.
4. Heard learned counsel for the parties and also perused the material available on record.
5. Having regard to the overall facts and circumstances of the case and considering the facts that other co-accused persons have already been granted bail by the learned trial Court, though the other criminal cases have been found to be registered against the present accused-applicant, but offences levelled against the accused-applicant are triable by a Judicial Magistrate; that the accused-applicant is behind the bars since 01.05.2026; that the charge-sheet has been filed and the trial will take a long time to conclude, without expressing any opinion on the merits/demerits of the case, this Court deems it proper to allow the bail application filed on behalf of the accused-applicant.
[2026:RJ-JP:34363] (3 of 3) [CRLMB-12432/2026]
6. Consequently, this bail application filed under Section 483 of the B.N.S.S, 2023 is allowed. It is ordered that accused-applicant Abhishek @ Narendra S/o Late Ramjilal, arrested in FIR No. 139/2026, registered at Police Station Mantown, Sawai Madhopur shall be released on bail; provided he furnishes personal bond in the sum of Rs.1,00,000/- and two solvent attested sureties of Rs.50,000/- each to the satisfaction of the learned trial Court.
7. The Accused-Applicant shall be required to appear before that Court on all dates of hearing and as and when called upon to do so.
