2. This is an application under Section 483 of the BNSS, 2023 praying for grant of bail to the accused applicant in connection with Hojai P.S. Case No. 91/2026 under Section 64 of BNS.
3. An FIR was lodged on 02.05.2026 alleging that on 30.04.2026 while the informant and the accused applicant were together after consuming
Page No.# 2/2 some beer, the accused applicant tried to forcefully sexually assault her. On the basis of the FIR, the Police registered the Hojai P.S. Case No. 91/2026 under Section 64 of the BNS. After completion of the investigation, the Police filed the charge sheet on 31.05.2026 and presently the case case is waiting for framing of the charge.
4. The learned counsel appearing for the accused applicant submits that the accused applicant is a young boy and he is already behind the bar after his arrest on 04.05.2026. He submits that since the charge sheet has already been filed and taking into account the long detention already undergone, the accused applicant should be enlarged on bail.
5. On the other hand, Ms. S. H. Bora, learned Addl. PP objected to the prayer for grant of bail to the accused applicant stating that the statement of the victim is yet to be recorded before the Trial Court and charges are yet to be framed.
6. Scanned copy of the Trial Court Record has been received and the same is perused.
7. Having found prima facie materials against the accused applicant, this Court is not inclined to grant bail to the accused applicant, at this stage and accordingly, the same is rejected. JUDGE Comparing Assistant
