Agrawal, Spl.P.P. ---- 02/13.05.2026 Heard learned counsel for the petitioner and learned counsel for the State. 2. The petitioner is apprehending his arrest in connection with Poraiyahat P.S. Case No.27 of 2026, for offence registered under sections 274, 275, 3(5) of BNS, 2023 and Section 47a of Excise Act, pending in court of learned Sub-Divisional Judicial Magistrate, Godda. 3. Learned counsel for petitioner submits that the petitioner has been falsely implicated in this case and the name of the petitioner has come on the confessional statement. He submits that the recovery of the liquor has been made from the house of the apprehended co-accused Kalicharan Baski. He also submits that petitioner has got one criminal antecedent as disclosed in paragraph no.14 of the petition. 4. Learned State counsel opposes prayer and submits that petitioner appears to be an accomplish of co-accused Kalicharan Baski. On this ground, he submits that anticipatory bail may kindly be rejected. --2-- 5. Considering that name of the petitioner has come on the confessional statement, and the criminal antecedent cannot be a sole ground either rejecting or allowing the anticipatory bail, I am inclined to grant anticipatory bail to the petitioner. 6. Accordingly, the petitioner, above named, is hereby directed to surrender before learned court within two weeks from today, and in event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to the satisfaction of learned Sub-Divisional Judicial Magistrate, Godda, in connection with Poraiyahat P.S.
