“….to Issue a Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus, declaring the inaction of the respondents in not processing the closure of contract, not finalizing the bill, and not releasing the final payments and deposits pertaining to the work.
'Improvements to Percolation Tank across Joreegala Vanka near Yanamanasana Palli (V), Kuppam (M), Chittoor District,' covered under Agreement No. 140 SE/2018-19, dated 17-11-2018, as illegal, arbitrary and violative of Articles 14, 19(1)(g), 21 and 300-A of the Constitution of India and consequently direct the respondents to process and finalize the petitioner's bills, settle the petitioner's account, and release all dues including Bank Guarantees and deposits, within a time bound period under Agreement No. 140 SE/2018-19, dated 17-11-2018 and pass such other order…”
2. Heard the learned counsel for the petitioner, the learned Special Government Pleader for Irrigation and the learned Assistant Government Pleader for Finance. 3. The petitioner claims to be engaged in execution of civil works and states that various works in Government Departments, including the Irrigation Department, were entrusted to it on a tender basis. It is its case that it was awarded a contract for execution of the work, viz. “Improvements to Percolation Tank across Joreegala Vanka near Yanamanasana Palli Village, Kuppam Mandal, Chittoor District.” It is its case that the petitioner completed

the work to the satisfaction of the authorities concerned and, upon completion thereof, the respondent authorities measured the work and recorded the measurements in the Measurement Book. It is stated that the Department has been insisting upon repeated renewal of the Bank Guarantees, which has resulted in an additional financial burden on the petitioner towards recurring bank guarantee charges. 4. Grievance of the petitioner is that, notwithstanding the completion of the work and measurement thereof by the competent authorities, the amount due towards the work executed by it has not been paid till date. According to the petitioner, though the work was completed long ago, the respondent authorities have failed to release the admitted amount payable to it. Aggrieved by the non-payment of the said amount, the petitioner has filed the present Writ Petition. 5.
Today, when the matter is taken up for hearing, without going into the merits of the case, learned counsel for the petitioner confines his submission stating that a representation dated 18.10.2025 was submitted by the petitioner to Respondent Nos.3 and 4, requesting closure of the work by mutual consent and settlement of the petitioner’s account, and seeks a direction to the respondent authorities to pass appropriate directions on the said representation. 5 SRK, J WP.No.33009 of 2025
6. A perusal of the record shows that, though the petitioner submitted a representation dated 18.10.2025, no orders have been passed thereon by the authorities concerned till date. 7. In view of the above, Respondent Nos.3 and 4 are directed to consider and pass appropriate orders on the representation submitted by the petitioner on 18.10.2025, in accordance with law, within a period of Four (4) weeks from the date of receipt of a copy of this order. 8. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. As a sequel thereto, the miscellaneous applications, if any, pending in this Writ Petition, shall stand closed. _____________________________ JUSTICE K. SREENIVASA REDDY Date: 28.09.2026. MS
