AD 13 IN THE HIGH COURT AT CALCUTTA March 17, 2026 Circuit Bench at Jalpaiguri Ct. 6 Criminal Miscellaneous Jurisdiction SG
CRM(A) 65 of 2026 Reject An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Kharibari P.S. Case No.107 of 2024 dated 07.04.2024 under Sections 376/511/506 of the IPC. And
In the matter of: Tarani Barman … petitioner
Mr. H.S. Podder … for the petitioner
Mr. A.S. Chakraborty
Mr. Kallol Acharjee
Mr. Bhaskar Das … for the State
Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. It is only a case of attempt to rape.
Learned counsel for the State strongly opposes the prayer for anticipatory bail and refers to the statement of the 13 year old victim recorded before the learned Magistrate and other materials available in the case diary. Considering the statement of the 13 year old girl and the other incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail.
The application for anticipatory bail is, thus, rejected. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
