Learned High Court Government Pleader takes notice for all the respondents. - 3 -

2. It is the contention of the petitioner that the petitioner's father late Sri. Kodige Shamanna alias Shamanna s/o Papayya was confirmed with occupancy rights in respect of 1 acre 22 guntas in Survey No. 91 of Thimmasandra village, Jala Hobli, Yelahanka Taluk on 12.10.1978 in proceedings bearing No.LND/RUC/608/1977-78. 3. The petitioner's father's name was entered in the revenue records. However, after computerisation the name of the petitioner's father was discontinued from the RTC and therefore the petitioner has given representations to the respondent-Tahsildar to continue with the name of the petitioner's father in the revenue records and thereafter consider the claim of the petitioner to enter his name in the revenue records in terms of the decree passed in O.S.No.337 of 2006 by the Civil Judge(Sr.Dn.) and JMFC, Devanahalli. - 4 -

After hearing the learned counsel for the petitioner, the learned High Court Government Pleader and on perusing the petition papers, this Court finds from the material on record that the name of the petitioner was earlier entered in the land revenue records. However, if the Tahsildar is of the opinion that the petitioner has not been granted lands, nevertheless, it is the duty of the Tahsildar to secure the original grant records, Saguvali Chit issue register and other contemporaneous records to satisfy himself regarding the grant made in favour of the petitioner. Moreover, there is no reason why the name of the petitioner’s father which was earlier entered in the land revenue records has not been continued after computerization, the Tahsildar is duty bound to look into all these aspects and pass necessary orders. 5. The writ petition stands disposed of with a direction to respondent -Tahsildar, Yelahanka Taluk, to verify from the records and find out if grant was made in favour of the petitioner’s father and if he has paid the

kimath. If it is found from the records that the facts stated hereinabove are true, then the Tahsildar shall proceed to enter the name of the petitioner’s father in the computerised RTC in accordance with law.
Thereafter, he shall look at who are the legal heirs of Sri Kodige Shamanna and proceed to enter their names and the name of the petitioner in terms of the decree passed by the learned Civil Judge (Sr.Dn.) and JMFC, Devanahalli, in accordance with law. The entire exercise shall be completed as expeditiously as possible and at any rate within a period of three months from the date of receipt of a copy of this order. Ordered accordingly. Learned High Court Government Pleader is permitted to file memo of appearance within a period of four weeks from today. Sd/- (R DEVDAS) JUDGE SKS
