2. Upon perusal of the record of the case, it is revealed that cross FIRs were registered between the parties and upon completion of investigation, Police filed the charge-sheet in FIR No.516/2004 against the petitioner for the offences punishable under Sections 323 and 341 of the IPC and in the cross-case also, the charge-sheet came to be filed for the offences punishable under Sections 323 and 341 IPC. 3. Thereafter, the petitioner was tried for the said offence by the learned Additional Chief Metropolitan Magistrate No.8, Jaipur Metropolitan-I (hereinafter, ‘trial Court’) in Criminal Case No.2273/2004 and was convicted for the offences punishable under Sections 323 and 341 IPC vide judgment dated 26.05.2016, however, the petitioner was granted the benefit of probation. Aggrieved by the aforesaid judgment, both the petitioner as well as the complainant preferred separate criminal appeals, which were heard together and came to be decided by a common
judgment dated 15.05.2017 by learned Additional Session Judge No.8, Jaipur Metropolitan-I, (hereinafter, ‘Appellate Court’) whereby the judgment dated 26.05.2016 was set aside and the
[2026:RJ-JP:30079] (4 of 6) [CRLMP-710/2026] matter was remanded to the learned trial Court with a direction to decide the case afresh along with the connected cross-case. 4. The aforesaid remand order dated 15.05.2017 was assailed by the petitioner by filing S.B. Criminal Miscellaneous Petition No.3236/2017 before this Court and the said petition came to be dismissed vide order dated 05.07.2017, thereby affirming the remand order passed by the Appellate Court. Pursuant to the remand order, the parties were directed to appear before the learned trial Court on 19.06.2017. During the pendency of the proceedings, the petitioner remained absent and failed to ensure his presence before the learned trial Court and warrants of arrest came to be issued against him and thereafter, the petitioner appeared before the learned trial Court and filed an application seeking bail and the same was allowed vide order dated 27.06.2022, whereby the petitioner was ordered to be released on bail. The present petition has been filed challenging the aforesaid proceedings. 5. Perusal of the record further reveals that during the pendency of the trial, the petitioner moved an application dated 15.09.2022 praying for summoning the Investigating Officer Ratna Singh, the complainant and Assistant Public Prosecutor as witnesses. The said application came to be considered and rejected by the learned trial Court vide order dated 05.01.2026. 6. Having considered the prayer of the petitioner and perusing the material available on record, this Court does not find any illegality, perversity or jurisdictional error in the impugned orders
[2026:RJ-JP:30079] (5 of 6) [CRLMP-710/2026] warranting interference in exercise of inherent jurisdiction of this Court under Section 528 of the BNSS. 7. However, it has come on record that a criminal revision arising out of the connected cross-case is pending before the learned Revisional Court and petitioner fairly submits that no interim order is operating in the said revision petition. 8.
Therefore, considering the peculiar facts and circumstances of the case and taking note of the fact that the criminal proceedings have remained pending for a considerable period, this Court deems it appropriate to direct the learned trial Court to conclude the trial of the present case as well as the connected cross-case expeditiously preferably, within a period of six months from the date of receipt of a certified copy of this order, if there is no legal impediment. 9. Accordingly, the trial Court shall send a requisition to the Court of Additional District and Sessions Judge No.4, Jaipur Metropolitan-I with the request to send the record of the connected revision case pending before it. On receipt of requisition, the said Revisional Court shall forthwith send the record to the trial Court, so that both matters may be decided together in terms of the remand order dated 15.05.2017. 10. The learned Revisional Court is also requested to decide the criminal revision arising out of connected cross-case within a period of two months and if, Revisional Court is required the record of the case, it may direct the petitioner to produce the certified copy of the record of the trial Court. [2026:RJ-JP:30079] (6 of 6) [CRLMP-710/2026]
11. The petitioner is directed to place a certified copy of this
order before the learned trial Court as well as Revisional Court for necessary compliance.
12. In view of the above, the present Cr. Misc. Petition is dismissed with the aforesaid observations and directions.
13. Stay application and pending application(s), if any, stand
disposed of.
