JUSTICE SURAJ GOVINDARAJ - 3 - HC-KAR NC: 2026:KHC:10305 WP No. 35106 of 2025 ORAL ORDER 1. Sri. B.S.Karthikeyan, learned counsel accepts notice for respondent Nos.1 to 5. 2. Petitioner are before this Court seeking for the following reliefs: a. Direct by issuance of writ in the nature of mandamus, directing the 2nd respondent to consider the representation issued to the respondents for issuance of e-khata and sanctioned plan as per the representation dated 30-10-2025 as per annexure-a. b. Direct by issuance of writ of mandamus directing the respondents to make an assessment of the schedule property and issue e-khata. c. Direct by issuance of writ of mandamus or any other writ directing the respondent no.4 and 5 to issue the sanctioned plan for restructuring over the schedule property. d. Pass such other order as this hon'ble court may deem fit in the above writ petition in the interest of justice and equity. 3. The contention of the learned counsel for the petitioners is that in respect to the property of the petitioner bearing Site Nos.29 and 47 formed in Survey No.15/3, Khata had been issued by the Grama Panchayath. Thereafter, on the property coming within the jurisdiction of the BBMP, an application having been made for grant of E-Khata followed up with a representation on 30.10.2025 at Annexure-A, the same has not been considered. - 4 - HC-KAR NC: 2026:KHC:10305 WP No. 35106 of 2025 4. Whenever any application for issuance of Khata (E-Katha) is made, it is required for the respondents to consider the same within the time prescribed under the Karnataka Sakala Services Act, 2011 And (Amendment) Act, 2014, and either by accepting or rejecting the said application/representation. 5. Needless to say, in either case, the order needs to be accompanied by reasons. In the present matter, neither having been done, I pass the following: ORDER i) Writ petition is petition allowed. ii) A mandamus is issued, respondent No.2 is directed to consider the representation of petitioners dated 30.10.2025 at Annexure-A in terms of the time prescribed under the Karnataka Sakala Services Act, 2011 And (Amendment) Act, 2014.
