JUSTICE DEVASHIS BARUAH ORDER Date : 05.08.2026 The present application has been filed alleging willful and deliberate violation to the order dated 05.02.2025 passed in WP(C) No.6960/2024 whereby there was a specific direction upon the Respondent No.3 therein i.e. the Additional District Commissioner (Revenue Branch), Dhubri to furnish the list of documents which according to him were not submitted by the Petitioners with their application dated 29.06.2024 within 7 (seven) working days from the date of submission of the certified copy of the order at the Office of the Respondent No.3. 2. The grievance of the Petitioners herein that in spite of the certified copy being submitted, the Respondent No.3 in the writ petition had not furnished the list of documents and it is under such circumstances, the present contempt application has been filed. 3. This Court had issued notice on 30.05.2025. None of the Respondents have put in their appearance. It is under such circumstances, on 15.07.2026, this Court requested Mr. J. Handique, the learned Junior Government Advocate to obtain instructions as to why the order dated 05.02.2025 passed in Page No.# 3/4 WP(C) No.6960/2024 have not yet been complied with. 4. In the said order, this Court further categorically directed the Additional District Commissioner, (Revenue Branch) Dhubri to furnish the list of documents to Mr. J. Handique, the learned Junior Government Advocate so that the same may be placed before this Court on the next date. 5. This Court put a specific query upon Mr. J. Handique, the learned Junior Government Advocate as to whether in compliance to the order dated 15.07.2026, the Additional District Commissioner (Revenue Branch) Dhubri has provided the list of documents to him. 6. Mr. J. Handique, the learned Junior Government Advocate has placed before this Court an instruction dated 03.08.2026 issued by the District Commissioner, Dhubri. Along with the said parawise comments, the list of insufficient documents were also furnished as Annexure-A. From a perusal of the said list of documents enclosed as Anenxure-A, it appears that the buyer’s affidavit which was uploaded in the Sewa Setu portal along with the NOC for land sale permission application, consideration amount was not mentioned thereby the affidavit became incomplete document. The instructions along with the enclosure which is the list of insufficient documents are collectively kept Page No.# 4/4 on record and marked with the letter “X”. 7. Taking into account the above, it is the opinion of this Court that nothing further remains in the instant proceedings to be proceeded with for which the instant proceedings stands dropped. 8. The Court Master of this Court is directed to provide a true copy of the document which is marked with the letter “X” to Mr. M. U. Mondol, the learned counsel for doing the needful.
