6 (RNT,J & AGD, J W.P.No.27703 of 2026)
ORDER :-(per Hon’ble Sri Justice Ravi Nath Tilhari)
This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:-
“….to issue a Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in not implementing the orders passed in O.A.No.8678 of 2011, dated 08.11.2011 as illegal arbitrary and further direct the respondents to implement the orders passed by the Andhra Pradesh Administrative Tribunal in O.A.No.8678 of 2011, dated 08.11.2011 and pass such other
order or orders….”
2. Heard Sri P.Raghavender Reddy, learned counsel for the petitioners, learned Government Pleader for Services-I appearing for respondent No.2, learned Government Pleader for Services-IV appearing for respondent Nos.1 & 3 and Sri A.S.C.Bose, learned counsel for appearing for respondent No.4.
3. The prayer in the Writ Petition is for a direction to the respondents to implement the order dated 08.11.2011 passed in O.A. No.8678 of 2011 on the file of the Andhra Pradesh Administrative Tribunal (for short, “the Tribunal”). The operative portion of the said order reads as under:
“4. In the present case also, the applicants have completed 5 years of service by the cut-off date. In these circumstances, this O.A. is also allowed. The respondents
7 (RNT,J & AGD, J W.P.No.27703 of 2026)
are directed to regularize the services of the applicants with effect from 25.11.1993 as per G.O.Ms.No.212. However, the applicants are not eligible for arrears of pay and they are eligible only for notional fixation of pay.”
4. It appears that as the respondents did not implement the order of the Tribunal in the O.A., the writ petitioners/applicants filed W.P.No.44139 of 2018, which was allowed on 16.09.2019 in the following terms:
“For the aforesaid reason, the writ petition is allowed, directing the respondents to take action as per the orders passed by the Tribunal in O.A.No.8674 of 2011, dated
08.11.2011. The said exercise shall be completed within a period of three months from the date of receipt of a copy of this order. There shall be no order as to costs.”
5.
Learned counsel for the petitioners submits that the respondents filed a review petition against the order dated 16.09.2019. The review petition was allowed and W.P.No.44139 of 2018 was restored to its original number. There is no dispute with regard to the fact that the review petition was allowed.
6. Thereafter, W.P.No.44139 of 2018 was disposed of by a Co-ordinate Bench of this Court on 08.07.2025 in the following terms:
“12. The petitioners are permitted to make a detailed representation with legal and factual basis within a period of two months from the date of receipt of a copy of this
order. Upon such representation, the respondent authorities shall consider and pass appropriate orders
8 (RNT,J & AGD, J W.P.No.27703 of 2026)
strictly in accordance with law, within a period of three months thereafter. 13.Accordingly, the writ petition is disposed of. There shall be no order as to costs.”
7. Pursuant thereto, upon receipt of the petitioners’ representation, the respondent authority, namely, the Commissioner, Greater Visakhapatnam Municipal Corporation, rejected the representation of the petitioners vide proceedings dated 20.05.2026 in R.C.No.94/2011-2012 Horticulture/D2, which reads as under:
“In view of the above Government Orders, the petitioners are not entitled to retrospective regularization of services from the date of completion of 5 years of service. Hence, the representation filed by Sri Y. Appanna and others for retrospective regularization of services is hereby rejected.”
8. The present writ petition is filed seeking implementation of the aforesaid order of the Tribunal.
9. In view of the aforesaid subsequent developments and the disposal of W.P.No.44139 of 2018 by the Co-ordinate Bench of this Court on 08.07.2025, we are of the considered view that the present Writ Petition is not maintainable and dismissed accordingly. However, liberty is granted to the
9 (RNT,J & AGD, J W.P.No.27703 of 2026)
petitioners to avail an appropriate remedy in accordance with law against the proceedings dated 20.05.2026, if so advised.
No order as to costs.
As a sequel thereto, miscellaneous petitions, if any pending, shall also stand closed.
