JUSTICE ANJAN MONI KALITA ORDER Date : 17.08.2026 1. Heard learned Counsel Mr. A.H.Ahmed for the accused-applicant. Also heard learned Addl.Public Prosecutor, Mr. R.J.Baruah for the respondent State. 2. This is an application filed by the petitioner namely, Somer Ali under Section 483 of the BNSS, 2023 praying for bail in connection with Goroimari PS Case No. 33/2026 (GR No. 536 (K)/2026)under Page No.# 2/3 Sections303(2)/305(a)/331(4)/3(5) of the BNS. 3. An FIR was lodged by the informant on 09.07.2026, alleging that accused persons named in the FIR had stolen the charger of his E-Rickshw from his residence. 4. It is submitted by the learned counsel for the accused applicant that one of the co-accused namely, Shoriful Islam has been granted bail in connection with this case. He submits that the recovered items have been recovered. He submits that accused applicant shall co-operate with the investigation and therefore, he prays that the accused applicant should be granted bail. 5. Case diary is yet to be received. 6. The learned Addl. Public Prosecutor opposes the bail prayer of the accused applicant. 7. Taking into account the aforesaid and after hearing the submissions of the learned counsel for the respective parties and as the stolen articles have already been recovered, this Court is of the considered opinion that the accused applicant should be granted bail at this stage. 8. Accordingly, it is directed that the accused applicant named above shall be immediately released from jail on furnishing bail bond of Rs.20,000/- with a suitable surety of like amount to the satisfaction of the learned CJM, Kamrup, Amingaon subject to the following conditions: i) The accused-applicant shall co-operate with the investigation and make himself available as and when called for by the investigating officer; and ii) The accused-applicant shall not try to tamer or Page No.# 3/3 hamper with the investigation in any manner, whatsoever. 9.
