By way of this petition, the petitioner has sought the following relief(s):- “10.1 That the Hon’ble Court may kindly be pleased to quash the order dated 27.03.2020 which relates stoppage of retiral dues of the petitioner till disposal of departmental enquiry and direct the respondent to provide all the retiral dues to the petitioner with 12% interest w.e.f. 31.03.2020. 10.2 Any other relief which the Hon’ble Court may deem fit and proper may also be passed in favor of the petitioner.” 2. Learned counsel for the petitioner would submit that the petitioner, who was SIDDHANT TAMRAKAR Digitally signed by SIDDHANT TAMRAKAR Date: 2026.03.30 18:32:27 +0530 2 holding post of Assistant Grade – II was placed under suspension on 07.11.2016 and a departmental enquiry was contemplated. He would contend that the petitioner retired from services on 31.03.2020, but till date departmental enquiry has not been concluded and retiral dues have not been paid. He would submit that a direction may be issued to the respondent authorities to finalize the pension case of the petitioner. 3. On the other hand, Mr. Abhishek Singh, Panel Lawyer would submit that provisional pension is being paid to the petitioner. He would submit that the departmental enquiry is still pending consideration, and immediately after conclusion of said enquiry, the decision would be taken by the respondent authorities. 4. I have heard learned counsel for the parties and perused the documents placed on record. 5. The petitioner retired from services on 31.03.2020, but till date departmental enquiry has not been completed though it was initiated in the year 2017. The petitioner has not been paid retiral dues till date, therefore, this petition, at this juncture, is disposed of with a direction to the respondent authorities to conclude the departmental enquiry within a period of 6 months from today, and immediately thereafter, the pension case of the petitioner shall be finalized. 6.
