The petitioners have prayed for quashing the order dated 29.09.2011 contained in Memo No. 2620 issued by Deputy Commissioner, Koderma, whereby an order has been passed for restraining transfer of rayati land situated at various Mauza in the District of Koderma. 3. It is case of the petitioners that land belong to the petitioners, but has been kept in the said prohibited list, which has been quashed by the Division Bench of this Court. 4. The State by filing an affidavit oppose the title of the petitioners. In the counter affidavit they have stated that on the basis of forged and fabricated documents, the petitioners are claiming title over the property in question. As per the said affidavit the land belongs to the State, the petitioners have got no title over the same, thus the land cannot be transferred. 5. Considering the submission of the petitioners and the State, since the dispute is in respect of right, title and interest over the land in question which needs to be decided by an appropriate Civil Court, I direct the petitioners to approach the Civil Court of competent jurisdiction for claiming their right, title, interest and possession over property in question by filing a suit, as this Court exercising jurisdiction under Article 226 of the Constitution of India cannot decide the same. 6.
