Heard learned counsel for petitioner and learned AGA for the State. 2. The petition is filed with the following prayer: "(a) Issue an order or direction, setting aside the impugned order dated 16.10.2025 passed learned Chief Judicial Magistrate, Firozabad in Misc. No.2386 of 2025 (Brahmanand Sharma Vs. M/s Z Worldwy Logistic), under Section 173(4) B.N.S.S., Police Station-Dakshin, District Firozabad and order dated 02.07.2026 passed by Sessions Judge, Firozabad in Criminal Revision No.77 of 2026 (Brahmanand Sharma Vs. State of U.P. and others), Police Station Dakshin, District Firozabad." 3. It is submitted by learned counsel for petitioner that petitioner has filed an application under Section 173(4) Cr.P.C. The same has been directed to be registered as complaint case. It is submitted by learned counsel for petitioner that advance amount was given to opposite party no.2 for supply of material, however, opposite party no.2 has not supplied the material and firm was closed. It is submitted that fraud has been committed. 4. The trial court has recorded a finding that inquiry can be made by the trial court itself under the complaint proceedings. This Court does not find any error in the impugned order. 5. Accordingly, the petition lacks merit and is dismissed. October 5, 2026 D.
