Ali, the learned counsel appearing on behalf of the Petitioners. Mr. J. Handique, the learned counsel appears on behalf of the sole Respondent. 2. The present contempt application has been filed alleging willful and deliberate violation to the order dated 21.11.2024 passed in WP(C) No.5176/2023. 3. A perusal of the order dated 21.11.2024 shows that on account of serious dispute between the Petitioners and the private Respondent in the writ petition, this Court directed the Deputy Commissioner to decide the inter se claims between the Petitioners and the private Respondent in the writ petition in respect of the land measuring 10 bighas 2 kathas 1 lechas covered by Dag No.373/408 at village Molakhowa under Mankachar Revenue Circle in the district of South Salmara, Mankachar. There was also a direction for the Deputy Commissioner to complete the said exercise within a period of 60 days from the date of receipt of the certified copy. It is noticed that upon receipt of the certified copy, a proceedings was Page No.# 3/3 initiated for compliance of the directions passed by this Court in the order dated 21.11.2024 passed in WP(C) No.5176/2023. 4. Today Mr. J. Handique, the learned Junior Government Advocate has placed before this Court an order passed on 16.06.2025 by the Additional District Commissioner, South Salmara wherein it was observed that the District Commissioner, South Salmara was unable to allot the land to the Petitioners without the approval of the land policy implemented by the Government. The said order is kept on record and marked with the letter ”X”. 5. Taking it into account the above, it is the opinion of this Court that the order having been passed on 16.06.2025, the same would be in substantial compliance to the directions passed by this Court. 6. Accordingly the contempt proceedings stands closed. 7. Before parting with the record, this Court, however, observes that the closure of the present contempt petition shall not affect the rights of the Petitioners to approach the Competent Court of Civil Jurisdiction, if so advised.
