The petitioner seeks challenge to the impugned order dated 11.06.2026 passed by the learned Deputy Commissioner of Police, Zone No.4, Nagpur thereby externing the petitioner under Section 56(1)(A)(B) of the Maharashtra Police Act, 1951. 3. A perusal of the petition reveals that the petitioner has not availed the statutory remedy of filing an appeal under Section 60 of the aforesaid Act seeking challenge to the impugned order. 4. In view of above, the learned counsel for the petitioner, upon instructions, seeks permission to withdraw the writ petition with liberty to approach the competent Appellate Authority for seeking challenge to the impugned order dated 11.06.2026 passed by the Deputy Commissioner of Police, Zone No.4, Nagpur City. It is made clear that we have not heard the present writ petition on merits. Also, the Appellate Authority is directed to consider the aforesaid appeal on merits and to consider the grounds as raised by the petitioner for the delay occurred in filing the appeal as submitted in the writ petition. 2026:BHC-NAG:12928-DB 2 CRIWP774-26.odt 5.
