CORAM:
MR. JUSTICE R.K. PATTANAIK
Order No.
ORDER 12.03.2026
01.
1. Heard learned counsel for the respective parties.
2. Instant petition has been filed under Section 482 BNSS by the petitioner seeking pre-arrest bail in connection with G.R. Case No.14 of 2026 arising of Muribahal P.S. Case No. 14 of 2026 pending in the court of learned J.M.F.C., Muribahal on the grounds stated.
3. Gone through the F.I.R. as at Annexure-1. The petitioner is a lady alleged to be a Labour Sardar. The report has been drawn up by the local P.S. alleging illegal transportation of the labour force and the petitioner being responsible for the same. It is alleged in the FIR at Annexure-1 that the petitioner paid Rs.35,000/- each from the labourers for a labour work in a brick kiln at Tirupati in the State of Andhra Pradesh. It is, however, informed to the Court that the petitioner is having no antecedent. Considering the above plea and objection of the State and under the impression that the petitioner is a first-time offender as is claimed but subject to
verification, this Court is inclined to direct her to surrender before the learned court below instead to go on bail with suitable conditions imposed.
4. Accordingly, it is ordered.
5. In the result, the ABLAPL petition stands disposed of with a direction to the petitioner to surrender before learned J.M.F.C., Muribahal within a fortnight from today and in the event, she surrenders in compliance thereof, shall be released on bail in connection with G.R. Case No.14 of 2026 on furnishing a bail bond of Rs.40,000/- (rupees forty thousand) with one solvent surety for the like amount to the satisfaction of the court below, which shall be at liberty to impose such other suitable conditions as deemed just and proper in the facts and circumstances of the case besides the following, such as, she shall cooperate the IO in the investigation and not to involve herself in any such illegal activities, while on bail. It is further
directed that the above order shall be given effect to only if the petitioner is having no similar criminal antecedent.
6. Issue urgent certified copy of this order as per rules.
