JUSTICE C.M. POONACHA ORAL ORDER (PER: HON'BLE MR. VIBHU BAKHRU, CHIEF JUSTICE) 1. Accused No.2 has filed a counter-affidavit stating that he was not a party to the writ petition being WP.No.33934/2011 (S-RES), which was disposed of by an order dated 05.09.2023. Therefore, he cannot be held responsible for performance of compliance with the said order. He also states that although he was made a party in CCC.No.315/2024, which was filed by the complainant alleging wilful disobedience of the order dated 05.09.2023, the same was not served. 2. We also find from the order dated 05.09.2023, which merely sets out that the Institution with whom the complainant was employed would be under the legal obligations to pay salaries, which the complainant was entitled to, as per the terms of the appointment. There are no specific directions issued to the Institution (Smt. Saroja Linganna Pre-University College), which was arrayed as respondent No.4 in the writ petition. The question - 4 - HC-KAR NC: 2026:KHC:13313-DB CCC No. 339 of 2025 regarding the complainant's entitlement to salaries from respondent No.4 is subject matter of a private dispute, which was not a matter of adjudication in the writ petition. 3. In view of the above, we are not persuaded to accept that there is any wilful disobedience of the order passed by this Court. 4. This petition is accordingly closed.
