The applicants have preferred this First Bail Application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Crime No.50/2025, registered at Police Station GOURI MUDALIAR Digitally signed by GOURI MUDALIAR Date: 2026.01.14 16:40:10 +0530 2 Purur, District - Balod (C.G.) for the offence punishable under Section 20(b) of NDPS Act. 2. As per the prosecution story, on 21.05.2025, at 14.10 hrs. on receiving information from an informant at Purur Police Station, during checking operations under Purur Police Station, a black colored Pulsar motorcycle without number plate was stopped and surrounded and the accused was arrested. On interrogation, the accused gave their names as Shahid and Mohd. Rafiz and said that they were hiding illegal drug ganja in two separate black bags they were carrying. After the documentary proceedings, the narcotic substance ganja was recovered from the bag in the possession of the accused, then the accused were given a notice in which no valid document was presented by them, thereafter a black red colour Pulsar vehicle without number, a packet of narcotic substance ganja wrapped with khaki colour tape weighing 7.770 kg, a packet of narcotic substance ganja wrapped with khaki colour tape weighing 7.810 kg, a packet of narcotic substance ganja wrapped with khaki colour tape weighing 6.570 kg, a packet of narcotic substance ganja wrapped with khaki colour tape weighing 3.320 kg, two black colour bags containing narcotic substance and a brown colour purse containing Rs. 1500/- cash, Aadhar card, a One Plus company mobile from the possession of accused Shahid and a black colour purse containing Rs. 1100/ cash, Aadhar card, PAN card and a Motorola company mobile from the possession of accused Rafiz were 3 seized and the accused were arrested. A rural complaint was prepared on the spot, on the basis of which a case under Section 20 (b) of the Narcotic Drugs and Psychotropic Substances Act was registered against the accused under Crime No. 50/2025 of Purur Police Station. 3. It has been argued by the learned counsel for the applicants that the applicants are innocent and have been falsely implicated in this case. He further submits that the charge-sheet has been filed, applicants are in jail since 21/05/2025 and the conclusion of the trial is likely to take some time, therefore, he prays for grant of bail. 4. On the other hand, learned counsel for the State opposes the bail application and submit that charge sheet has been filed in this case before the competent court. He would submit that total 25.470 Kgs Ganja have been seized from the joint possession of the applicants who were carrying it in a motorcycle which is much more than the commercial quantity, therefore they are not entitled to be released on bail. 5. I have heard learned counsel for the parties and perused the material available on record. 6. Taking into consideration the fact that quantity of contraband article i.e. 25.470 Kgs Ganja have been seized from the joint possession of the applicants who were carrying it in a motorcycle, which is much more than the commercial quantity and the 4 applicants have failed to give any explanation for the same and it cannot be said to be a case of false implication, therefore, this Court is of the opinion that it is not a fit case to enlarge the applicants on regular bail. 7. Accordingly, the bail application of applicants Mohammad Sahid & Mohammad Rafiz involved in Crime No.50/2025, registered at Police Station Purur, District - Balod (C.G.) for the offence punishable under Section 20(b) of NDPS Act, is rejected. 8.
