Page No.# 2/3 praying for grant of regular bail to the accused/applicant, namely, Shri. Roushan Thakur in connection with Dispur P.S. Case No. 549/2026 registered under Sections 74/ 75/ 64(1)/ 62 of the BNS, 2023. 3. An FIR was lodged by one Ms. Uddepti Deori on 28.07.2026, alleging that on 26.07.2026 at 08:55 PM, when she had gone to Six Mile after being invited by one of her friend for dinner and to spend some time together, her friend namely, Rachel Lyngdoh got intoxicated and eventually lost consciousness. It is alleged that one Roushan Thakur, the accused/ applicant knocked her door and when she opened the door, he forcefully pushed her inside and tried to kiss her against her will. He even tried to touch her private parts without her consent. It is alleged that she became frightened and immediately called her some other friends and thereafter, her friends rescued her. 4. In view of the aforesaid, the police registered Dispur P.S. Case No. 549/2026 under the aforementioned sections. 5. The learned counsel for the accused/ applicant submits that there was some misunderstanding during the party that the accused/ applicant and others along with the informant were having on the night of 26.07.2026. He submits that, in fact, the FIR was lodged by the informant due to certain misunderstandings and the same has been stated by the informant in an affidavit sworn by her on 28.07.2026 before the Notary Public. He further submits that some one of the other co-accused person namely, Angshuman Lahkar, who was also there during the party has been released by the learned Special Judicial Magistrate First Class, Kamrup (M) dated 28.07.2026, wherein it has been mentioned that a written settlement agreement has been arrived at between the informant and other parties involved. Taking into account that an affidavit has already been sworn by the informant stating in clear terms that FIR was lodged due to certain misunderstanding and she does not have any grievances against the accused/ applicant anymore, this Court is of the considered opinion that accused/ applicant should be released on bail at this stage. 7.
Accordingly, it is directed that the accused/ applicant shall be released on furnishing of a bail bond of Rs.30,000/- (Rupees Thirty thousand only) with a surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Kamrup (M), Guwahati subject to the conditions as follows:- i. that the accused/ applicant shall co-operate with the investigation. ii. that the accused/ applicant shall make himself available as and when required. iii. that the accused/ applicant shall not directly or indirectly try to hamper or tamper with the investigation in the instant case. 8. In terms of the aforesaid directions, the instant bail application is
disposed of.
