1. The petitioners are the retired employees of the Jammu and Kashmir Institute of Management, Public Administration and Rural Development (for short ‘the J&K IMPARD’) and have come up with this writ petition for commanding the respondents to grant pensionary benefits being pension, gratuity and other consequential benefits as per Government Order No.1192-GAD of 2005 dated 27.09.2005.
2. The respondents in their response have stated that the appointment /regularization in respect of the petitioners appears to have been issued without following the procedure and without the approval of the competent authority. However, in
order to remove deficiencies/infirmities in the regularization order/issued by the J&K IMPARD in favour of the petitioners, settlement of the pension case of the petitioner was submitted before the 9th meeting of the Sub- Committee of the Executive Council of J&K IMPARD, which after due consideration opined that the case of the petitioners be forwarded to the Department of Law, Justice & Parliamentary Affairs and Finance Department for its opinion.
3. When the matter was taken up today, learned counsel for the respondents submits that decision would be taken by the Executive Council of J&K IMPARD only in its meeting, which is scheduled in the second week of the June, 2026.
4. At this stage, Mr. Azhar ul Amin, learned counsel for the petitioners submits that this writ petition can be disposed by directing the respondents to decide the claim of the petitioners for grant of pensionary benefits within some stipulated period.
5. Learned counsel for the respondents is not averse to the submissions made by Mr. Azhar ul Amin-learned counsel for the petitioners and more particularly in view of the response filed by the respondents only.
6. In view of above, this writ petition is disposed of by directing the respondents to consider and decide the claim of the petitioners for grant of pensionary benefits in accordance with law, within a period of two months from the date a copy of this order is served upon the respondents.
7. Disposed of.
