Sri Kumar Akhilendra Singh, Advocate holding brief of Sri Shivendra Raj Singhal, learned counsel for the applicant and Sri Karunakar Singh, learned A.G.A. for the State are present. The present application under Section 528 of the Bharatiya Nagarik Suraksha Sanhita has been filed to quash the order dated 25.08.2026 passed by Additional Sessions Judge/F.T.C., Court No.- 1, Agra in Session Trial No. 593 of 2019, arising out of Case Crime No. 1192 of 2018, under Sections 376, 323, 504, 506 and 120-B of I.P.C., Police Station- New Agra, District- Agra, whereby an application to obtain certain documents that had not been taken in the defence evidence. Learned A.G.A. pointed out that during the trial victim had stated that she told the Investigating Officer that physical relations with the applicant/accused were made on her own consent. After some arguments, learned counsel for the applicant does not want to press this application and wants liberty to file an appropriate application/ proceedings before the court of competent jurisdiction. Certified copy of the order may be returned to the learned counsel for the applicant after retaining a xerox thereof. In view of the above, the application is dismissed as not pressed with the aforesaid liberty.
