HIGH COURT OF JUDICATURE AT ALLAHABAD CRIMINAL MISC. BAIL APPLICATION No. - 32700 of 2026 Court No. - 67 HON'BLE JITENDRA KUMAR SINHA, J. 1. Heard Sri Azad Khan, learned counsel for the applicant and Sri B.P. Singh, learned A.G.A. for the State. Second supplementary affidavit filed today is taken on record. 2. The instant bail application has been filed with a prayer to release the applicant on bail in Case Crime No. 27 of 2026, under Sections 64(1), 352, 351(3) BNS, Police Station Jalalpur, District Hamirpur, during the pendency of the trial. 3. It is contended by the learned counsel for the applicant that the applicant has been falsely implicated in the present case and there is no allegation of rape in the FIR and there is allegation of sexual harassment and outraging the modesty of the victim and there are material contradictions in the statement of the victim recorded under Sections 180 and 183 BNSS, however, on perusal of the statement of the victim recorded under Sections 180 and 183 BNSS, the same is highly unbelievable. It is further submitted that the victim is major lady aged about 20 years and the medico-legal report of the victim does not support the commission of rape on her. It is also submitted that the applicant has been languishing in jail since 1.4.2026 and he is having criminal history of 12 cases which has been duly explained in the memo of application and second supplementary affidavit. It is lastly submitted that in case the applicant is granted bail, he will not misuse the liberty of bail and would cooperate in the trial proceedings. There is no allegation of rape in the FIR and there is allegation of sexual harassment and outraging the modesty of the victim, however, the victim in the statement recorded under Sections 180 and 183 BNSS has stated that the applicant committed rape on her and it is submitted that the victim in her statement has stated that while committing the rape by the applicant, some of the family members reached and witnessed the alleged incident which is improbable.
