That the Hon'ble court may kindly be pleased to call for the entire Records pertaining to the case of the petitioner in lieu of the FIR bearing no.07/2018 registered at P.S. State Economic Offence Bureau, Raipur. quash/set-aside impugned FIR dated 28/04/2018. ii. That this Hon'ble Court may kindly be pleased to Quash the Charge-Sheet and further Proceeding pending against the petitioner before the Special Judge (Prevention of Corruption Act) Durg (C.G.) (Annexure-P/1) in special Case No. 3/2019 and the consequential proceedings initiated in lieu thereof. iii. That this Hon'ble court may further be pleased to pass any other order in favor of petitioner as it may deem fit and proper under the facts and circumstances of the case with cost.” 3 At the outset, learned counsel for the petitioner submitted that there exists an interim order dated 18.05.2023 in favour of the petitioner, whereby it was directed that “no coercive steps shall be taken against the petitioner” and it was noted that the trial is in progress, with statements of 14 out of 22 prosecution witnesses having been recorded. Learned counsel for the petitioner has, accordingly, prayed for withdrawal of the present petition. 3 4 Learned counsel appearing for the State has no objection to the prayer made by the petitioner. 5 In view of the above, the present petition is dismissed as withdrawn, with liberty granted to the petitioner to co-operate with the investigation. 6 The interim order dated 18.05.2023 shall stand vacated.
